Welcome to www.gigmarket.com (GM), a company of HUSTLR, Inc’s Service, which may be accessed through GM's mobile application for iOS and Android devices and its Website and which allows service providers and people in need of chores and small jobs being performed at their residence or place of business to connect. HUSTLR, Inc., a Delaware corporation ("HUSTLR" or “Company” or "we" or "us" or "our") respects your privacy and is committed to protecting it through our compliance with this policy. This privacy policy ("Policy") describes how GM treats information collected or provided in connection with transactions, activities, and data gathered when your, the user (“you” or “User”) visits or uses the GM Website or App (“Site”). Any capitalized terms used and not defined in this Policy shall have the meaning given to them in the Terms of Use.

Please note that the use of the GM Site constitutes your acceptance of this Policy. If you do not agree with how we have determined to handle your information, please do not visit or use the GM Site. The GM Site is only intended for use in the United States and the personal information you provide us as a user will be stored in the United States.


2.   Effective Date and Changes

This Policy applies to all information collected by or provided to us on or after the Effective Date:

  1. Through our Site including our Website and App.
  2. In emails, texts, and other electronic messages between you and the Company.
  3. Through our service relating to network connections between your website and third parties who may access, or attempt to access, your website.

Your continued use of our Website or App after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.


3.   Children Under the Age of 13.

Our Website is not intended for children under 13 years of age. No one under age 13 may provide any personal information to the Website or App. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on our Website or App or on or through any of its features/register on the Website or App, make any purchases through the Website or App, use any of the interactive or public comment features of our Website or App or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. We collect, or may collect, several types of information from and about users of our Website or App, including information:

By which you may be personally identified, such as name, postal address, e-mail address, telephone number, tax identification numbers, username, age, birth date or any other information the website collects that is defined as personal or personally identifiable information under an applicable law that could be used to identify, contact or locate you directly without using the GM Site (“personal information”); and/or.
  2. About your internet connection, the equipment you use to access our Website or App and usage details.

We collect, or may in the future collect, this information:

  1. Directly from you when you provide it to us.
  2. Automatically as you navigate through the Website or App. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
  3. From third parties, for example, our business partners, if any.

When you visit or use the GM Site, we collect information about you in the following general categories.

  1. Location Information: Precise location data is collected through the App when it is used by Providers if the Providers' devices permit such information collection. This information may be collected when Providers use certain functionality, such as navigating to a location to provide the Services, and we may also collect the precise location of a Worker’s device when the App is running in the foreground or background. We may ascertain a Worker’s approximate location from the Worker’s IP address. The GM Site utilizes geo-location features to match You to Providers, to update You on the status of Providers who are proceeding to the Customer location to perform Services, to confirm that a Worker performed Services, and to improve the services on the GM Site.

    We also may use and disclose collected geo-location for legal purposes (such as to enforce our agreements) and in the event of a proposed or actual merger, sale, or other business asset transfers or other lawful business purposes. The geo-location information obtained about a User will be retained in an identifiable manner, along with geo-location data about job sites where Providers performed Services on initial and/or follow-up jobs.

  2. Transaction Information: We collect transaction details related to your use of the GM Site, such as type of service requested, date and time of service, amount charged, distance traveled, communications between a customer and Worker, ratings and reviews, and other related transaction details.
  3. Worker Registration And Payment: To register as a Worker, you may need to provide other personal information, including your social security number, bank account and a U.S. government-issued I.D. If required by an applicable jurisdiction, we may collect additional business or contractor licenses. To make sure Providers get paid, we keep information about Worker’s bank routing numbers, tax information, and any other payment information provided by Providers. To keep your data secure, we do not store your full bank account information or social security number on our servers.
  4. GM Payment Method: We will use a third party processor to handle all payments made through our site. When you add a credit card or payment method to your GM account, the third party processor will receive your card information. To keep your financial data secure, we do not store full credit card information on our servers.
  5. Communications Between You: We will use a third-party service to mask the telephone numbers used during calls or texts (SMS) between people using our system. We will not reveal telephone numbers submitted on file, although we store any call data, including associated date, time, and content.
  6. Third-Party Site Account Access: If you log in to the GM Site through a social networking site, such as Google or Facebook, we may collect your authentication token, registration information, and account identification number and use that information to provide you with access to your account on the GM Site.

5.   Information You Provide to Us.

The information we collect on or through our Website or App may include:

  1. Information that you provide by filling in forms on our Website and App. This includes information provided at the time of registering to use our Website and App, subscribing to our service, posting material, or requesting further services.
  2. Records and copies of your correspondence (including email addresses), if you contact us.
  3. Your responses to surveys that we might ask you to complete for research purposes.
  4. Details of transactions you carry out through our Website or App and of the fulfillment of your orders. You may be required to provide financial information before any order is confirmed with an Worker through our Website or App.
  5. Your search queries on the Website or App.
  6. Information collected through communications with our customer support team
  7. Information that is generated automatically about how you and visitors interact with the GM Site, preferences expressed, and settings chosen. When we associate such information with specific personal information, we will treat the combination as personal information, as set forth herein.
  8. Information about your mobile device, including the following examples: the hardware model, operating system/version, software names/versions, file names/versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information
  9. Information automatically collected when you interact with the GM Site, which may include device IP addresses, access dates and times, app features or pages viewed, app crashes and other system activity, browser type, and the third-party site/service accessed immediately prior to interacting with the GM Site.

By using the GM Site, you are authorizing us to collect, parse, and retain data related to the provision of the GM Site. However, we also provide you with options and choices regarding how we use and disclose some or all of your personal information, as set forth specifically below, including how to access, correct, and/or remove it. You may avoid further said data collection by uninstalling the App from your mobile device and not otherwise using the GM Site.

If you provide information to be published or displayed (hereinafter, “posted”) on public areas of the Website or App or transmitted to other users of the Website or App or third parties (collectively, “your Posts”). Your Posts are posted on and transmitted to others at your own risk. Although access to certain pages may be limited by the privacy settings for such information you set in your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website or App with whom you may choose to share your Posts. Therefore, we cannot and do not guarantee that your Posts will not be viewed by unauthorized persons.


6. Information We Collect Through Automatic Data Collection Technologies.

As you navigate through and interact with our Website and App, we may use automatic data collection technologies and other means to collect certain information about your equipment, browsing actions, and patterns.


7. How We Use Your Information.

  2. To contact you in connection with your GM-related activities (including, but not limited to, confirmation emails, account verification text messages, push notification alerts.

  6. To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  8. To allow you to participate in interactive features on our Website or App.
  9. For identification and authentication.
  10. For security and fraud prevention.
  11. To perform background checks.
  12. To investigate potential unauthorized use of your information by a Worker.
  13. To communicate about prospective Customers for your services.
  14. To periodically evaluate and improve the GM online and App experience.
  15. In any other way we may describe when you provide the information.
  16. For any other purpose with your consent.

We may also use your information to contact you about our own and third-parties’ goods and services that may be of interest to you. If you upload photos to GM, GM will only use your photos specifically for GM Site related purposes, such as showing job-related pictures as well as marketing, advertising, and other related purposes, unless we otherwise expressly obtain your individual permission. GM permits Users to post job-related pictures to third-party websites and apps. GM will not share your Photos with other third parties for their direct marketing purposes.


8. Advertising and Advertising Opt-Out Provisions.

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria. However, we do not rent, sell, or share your personal information with other parties or nonaffiliated companies for their direct marketing purposes without your express consent.

We may also send you email and other messages with personalized offers and information about products and services, and we may use personal information to show you online advertising on the GM Site, other websites, and other online services.

GM provides you the opportunity to opt out of receiving email marketing communications from us and our partners and gives you the option to remove your information from our database, to not receive future email marketing communications, or to no longer receive our service. Third parties may use cookies, web beacons, and other storage technologies to collect or receive information from the websites and apps you visit and elsewhere on the internet and use that information to provide measurement services and target ads. You may be able to opt out of receiving personalized advertisements from advertisers and/or advertising networks.

You may also be able to change your mobile device settings to opt out of personalized advertising through apps.

Please note that when you opt out of personalized advertising, you may continue to see online advertising on the GM Site and/or our ads on other Internet websites unless you subscribe to GM’s premium status.

Some content or applications, including advertisements, on the Website or App are served by third-parties, including advertisers, ad networks and servers, content Providers, and application Providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

If you delete your Posts from the Website or App, copies of your Posts may remain viewable in cached and archived pages or might have been copied or stored by other Website or App users. HSTLR EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESSED OR IMPLIED, WITH RESPECT TO ENSURING, GUARANTEEING, OR OTHERWISE OFFERING ANY DEFINITIVE PROMISE OF SECURITY IN CONNECTION WITH YOUR PERSONAL INFORMATION OR USAGE INFORMATION AND FURTHER DISCLAIMS ANY LIABILITY THAT MAY ARISE SHOULD ANY OTHER INDIVIDUALS OBTAIN THE INFORMATION YOU SUBMIT TO THE HSTLR SITE.
